Google, YouTube Won Over Viacom

After three long years, the rift between Google and media giant Viacom came to an end (for now), after U.S. District Judge Louis Stanton granted summary judgment in favor of Google. However, Viacom stated that they will be appealing for the case at the Court of Appeals, and will eventually bring the case in the light of the Supreme Court.

 

"The court has decided that YouTube is protected by the safe harbor of the Digital Millenium Copyright Act (DMCA) against claims of copyright infringement," Google said after the court decision was made.

"The decision follows established judicial consensus," ... "that online services like YouTube are protected when they work cooperatively with copyright holders to help them manage their rights online," Google added.

But Viacom is firm with their stand about the copyright-infringing materials uploaded on YouTube. As such, they will bring the case to the appeals court.

"We believe that this ruling by the lower court is fundamentally flawed and contrary to the language of the Digital Millennium Copyright Act (DMCA)," Viacom said in a statement. "We intend to seek to have these issues before the U.S. Court of Appeals for the Second Circuit as soon as possible."

Judge Stanton however, said that Google's YouTube was able to comply with the request of the video owners to remove the clips they find infringing, and they did it in a swift manner as soon as they received such requests. YouTube clearly showed cooperation with the property owners. With Google/YouTube doing that, they made themselves qualified for DMCA protection.
